ينص المرسوم الوزاري 48 على أن حضانات أماكن العمل يجب أن تكون «مجهزة لاستيعاب الأطفال ذوي الإعاقة»، كما أكد القانون رقم 10 لسنة 2018 بشأن حقوق الأشخاص ذوي الإعاقة أن الإدماج والمشاركة المتساوية حق قانوني للأطفال ذوي الإعاقة.
 يضمن هذا الإطار انتقال الحضانة من الدعم العشوائي أو ردود الأفعال المؤقتة إلى نظام منظم وواضح، من خلال توفير الأنظمة، والمستندات، والبنية التشغيلية اللازمة لترسيخ الإدماج بثقة داخل الممارسات اليومية.
